1) Overview

By accessing mariacarlisleartgallery.com or purchasing from us, you agree to these Terms. If you don’t agree, please don’t use the site.

2) Products & availability

We sell original artworks (and, at times, prints/frames). Colors and textures may vary due to screen differences. We reserve the right to limit quantities or discontinue items.

3) Pricing, taxes & currency

Prices are shown in USD unless stated otherwise and exclude taxes, duties, and import fees due at delivery, which are the buyer’s responsibility.

4) Orders, payment & verification

When you place an order, you’re offering to buy the item(s) under these Terms. We may refuse/cancel orders (e.g., suspected fraud). Payments are processed by our payment providers; we don’t store full card numbers.

5) Shipping, risk of Loss & Title

We ship to the address you provide. Title and risk of loss pass on delivery to the carrier unless local law says otherwise. Inspect packages at delivery and note carrier damage where possible. All items shipped from our facilities are insured at the value of the item. 

6) Cancellations & Returns

  • Cancellation: Request within 48 hours of order confirmation and before shipment; once shipped, use the return policy below. 

  • Returns: For non-commissioned items, you may request a return within 14 days of delivery. Items must be in original condition and packaging.

    • Change of mind: You cover return shipping/insurance.

    • Damaged or not as described: We cover return shipping and issue a full refund upon carrier’s confirmation and our inspection (aligns with marketplace guarantees).

  • Final sale: Commissions, custom framing, and bespoke modifications are non-returnable.

  • Return process: Email carlisleartgallery@gmail.com with your order number and photos (if damaged). We’ll provide a return authorization and label (if applicable).

  • Refunds: Issued to the original payment method after we receive and inspect the item.

7) Authenticity

We stand behind authenticity of original works and, where applicable, provide documentation. Report authenticity concerns promptly.

8) Intellectual property

All site content (images, text, logos) is owned by us or our licensors and protected by IP laws. You may not use content without permission. Maria Carlisle Art Gallery retains copyright of their Artist's works; purchasing a work does not grant reproduction rights.

9) User content & reviews

If you post reviews or uploads, you grant us a non-exclusive, royalty-free license to display and distribute that content in connection with the site and our social channels. You represent you have rights to the content and that it complies with law.

10) Prohibited uses

No unlawful activity; no attempts to interfere with the site, scrape data, or infringe IP.

11) Disclaimers; limitation of liability

The site and products are provided “as is” to the fullest extent permitted by law. We’re not liable for indirect or consequential damages. In no event will our total liability exceed the purchase price of the item at issue, except where law requires otherwise.

12) Indemnity

You agree to indemnify us for claims arising from your misuse of the site or violation of these Terms.

13) Governing law & venue

These Terms are governed by Florida law, without regard to conflicts rules. Exclusive venue is Miami-Dade County, Florida courts. 

14) Changes

We may update these Terms; continued use after posting is acceptance of the changes.
